this is an over view
In 2009 BOA took over my mortgage. We sent letters disputing the amount of the loan it was almost 15K higher. (Last company bill was like we owed 86-87K)BOA put us at 103K this started the whole fiasco. I did not pay escrow for tax or insurance. My wife was complaining that the bill was sky high (1500) our mortgage payment is 839.00. We sent a letter and called they said they did an audit? And we are delinquent on our taxes. (Funny I have a receipt for all my taxes paid) and they can enforce payment for escrow. This took like 3 to 4 months and while we waiting to hear from them they are hitting us with lates on our credit report. I did not catch this till it was too late the report had us so far behind we could not get a pair of slippers on credit, let alone a refinance on my home. I have kept all correspondence and everyone’s name and ID number that I have spoken with. When I sent the letter with the copy of my paid taxes all I got for a response was WELL YOU NEED TO PAY IN A TIMELY MANER!. They paid my taxes after I had already paid them! I got a refund from the town. This has been going on long enough! This was done deliberately and with specific intent to foreclose on my home!. As my mortgage is not upside down and I can more than afford it and would have just refinanced and moved away from BOA if my credit was not destroyed by deliberate intent by the deceitful bank with under handed tactics they use. I would love to do this myself but I want this to actually HURT THE BANK and detour them from doing this to other people as I’m sure iam not alone I’ll bet this is wide spread and just not as in front as the straight forward foreclosures . I have already sent a Debit Validation letter and the only response is we are looking for the documents and the time is running out for them. If they do not hold the note and deed of trust can they hit my credit report legally?? As the server and not the trust holder I would think they would want to work with me on this and get it resolved… Not take the stand WE THE MIGHTY BANK. And we are never wrong. I feel this is and was done deceitfully by the bank. And hope you can help me.
