In April of 2007 we received a loan from Countrywide the day before our house was going up for auction at 9.875 interest rate. In Nov of 2009 Bank of America, who is servicing the loan for Bank of New York, had my Hamp applicaion. They told me it could take up to 90 days so I called in Feb of 2010 and they told me it could take up to 180 days. I called them in May of 2010 and they told me it was in processing being considered and I should get an answer shorly. I called about every two weeks to check and each time they told me it was still being decided. I told them they had all the info and all they had to do was make a decision. They told me they would expidite it and that should speed things up. It went this way until around mid August when they told me I would have to fill out another application since so much time had passed. I told them the only reason so much time had passed was because of their stall tactics and not my fault. I also told them to go by the original application but to no avail. I went to work and that changed my income status but now I am right back where I started; unemployed and paying too much. I just received my new \”packet\” as they refer to it and don\’t want to have the same thing happen again, which I am sure will.
Ocwen stated that they would give me a loan modification with a fixed rate last year 2010. Every month my principal and mortgage payment continues to escalate higher and higher, and now they are telling me that the monthly payments I have sent in are being applied to my escrow account and this was not clarified at the time of the modification. They are adding late fees and I am not late, they are adding additional fees that are not correct such as certified mail and I have not received any certified mail. My principal is going up higher and higher every month and I have been submitting my payments on time every month.
Hi, this is claim is about Home
Modification Loan that we filed
with American Express ( our Mortgate Co,) They failed us couple years ago. I want to submit this claim with you see if it can be in the class action law suite? Please contact me with the address. Greatly appreciate and thank you.
HFC does \”private label\” mortgage loans, securitizes them, but keeps all the docs to pretend it is an old fashioned mortgage loan.
my loan was taken over by J P MORGAN CHASE and when I was 2 payments behind I made a payment and they returned it starting default we tried several times to modify the loan with them am\\nd they refused.
The lender BoA was not want to work with me to reduce my payments and has drove me into bankrupcy in order to try to save my home in Virginia. the loan was to steep and BoA is not interested in making me whole and had me pay PMI. I aim still interested in keeping my house but this loan was put upon me by fraudelent means and I was caught unaware. I did not have a lawyer present when I sign the loan papers. I had even suggested a loan payment that would be reasonable and would not cause me to dip into my retirement account until it was dry. All they were looking at is that I had a loan to pay and was not interested really in lowering my loan amount to pay off the loan. I now want to sue them.
This nightmare began when PHH increased my motgage payment from $2,300 to $3,200 which I did not budget for. I feld behind in my payments and soon enough I got a letter fom the bank that I would fall into a forclosure if I didn\’t make the mortgage payments. I did everything in my power to get help from the bank and lawyer. but all got was apply for forberance, apply for modifications.
Hardly anyone in bank knew what the process was of how to apply. At the moment I am in forclosure status. Please help I don\’t want to lose my home.
At the end of 2004 I was looking into purchasing my own home in Killeen, TX. I was an active duty, U.S. Army Iraq war veteran. A Century 21 realtor was having problems finding someone to finance me, saying that no one in the area would touch a VA loan. I knew my score wasn’t the best, but it was almost mid-600s (640). At some point she brought in an Individual third party, he stated that he could guarantee me a home mortgage in 30 days, and he did. Ameriquest took the loan, with an ARM, stating that if I made my payments on time in the first couple of years, they would change it to a fixed. Before the first month was due, Countrywide purchased my mortgage. Years after, even paying on, my ARM would hit 11-13% interest. Making my mortgage over $1000 a month. As a single mother of three, and a soldier of limited income, this became very stressful. Since then I can not really deal thinking about this home, and my PTSD not flair up. Anxiety attacks, panic attacks, and lots of stress. Bank of America now “holds” the mortgage. I was contacted by a law firm, stated I was part of fraudulent loans through Countrywide, but they wanted $2000 to process my case, which I do not have. Please help
