Always say they didnt recieve payment had to gaet additional loans to make these ubrecieved payments. Economy is down and now I cant afford to make the mortgage and they want to foreclose or do a deed in luei since I am unemployed

Wyoming GMAC Mortgage Complaint

To whom it may concern;

I believe I have been fraudulently foreclosed upon. I have spoke with numerous lawyers and they feel that I have a good case, but they are not taking on any more clients at this time. I was recently contacting GMAC prior to the foreclosure date to try to work out arrangements to pay back the delinquent amount. On Feb 24th I was contacted by GMAC and told that I was in review for a modification and that all foreclosure proceedings will be postponed. At this point I was relieved. The GMAC rep. told me to call the following week to get all the information on the modification, for it would take them a few days to figure out all the paperwork. On Feb. 28th they foreclosed on my home and sold it. I found this out after I called back to see what my new payments were. Till this day I have applied for the HAMP program and numerous “GMAC” in house programs. I was approved for a temporary loan modification prior to foreclosure, but was only given 2 days to make the $1250.00 payment. I tried to call GMAC to make arrangements on this to be paid after my payday, and they said no. therefore I was in default of a temporary loan modification. After I applied for the HAMP program they didn’t tell me for weeks that I was denied. I even hired US Doc Prep to prepare all my documents for GMAC, so there would be no confusion. US Doc Prep said that I would have no problem getting approved for this program. GMAC told me that I did not qualify. I think they just want to sweep this under the rug and collect the money for their pockets. They said in order for me to reinstate this loan I would need to come up with almost $25,000.00.not counting attorney fees. That is far from the $10,932.12 that is on my paperwork. I have done some extensive research in the last few months, and found out that I am not the only person in this situation. I do not know were else to turn. I have no other options. Please help. I can provide more information upon request.

Washington EMC Complaint

In 2/09 I started the modifying process with EMC/Chase. after jumping thru many hoops, they offered me a loan modification in 6/10 with 1st pmt due 8/1. I made 2 payments after I signed the documents and sent them back in. they accepted these payments. when I called to make my 3rd payment they said I owed 25,000 I said what I have the modification, he said he saw it in the records but for some reason it wasn\’t recorded. he told me to call the underwriter, I did and got no response. Now they say I have to pay 35k to stay in my house. over these past several months I did pay a variety of payment amounts (1550, 675, 1327.31) they show no record of these payments adds up to 24k. after I signed and sent back the loan modification they sent, they sent another with not as good a terms. and they were tacking on the full 35k to the loan balance. Help please. Jenny

Midlothian Virginia Chase Home Finance Complaint

Just turned down for modification which has been in process since Sept. 2008 for \”failure to product required documentation\”. They have been given \’07, \’08 tax returns, \’09 taxs extension (W2 from NY Life is not correct, stil trying to get it corrected through the IRS), all W2\’s from \’09, financial information, 8 bank statements in \’09 and \’10, the last of these resubmitted docs was in Oct. 2010, when I was told that my loan mod was in underwrtitng and I would have a final mod within 2 weeks by Kristine N. Smith with JPM Chase.. Her email is kristine.n.smtih@jpmchase.com. Then suddenly, out of the blue they wanted to verify my 23 year old \”son\’s income\” saying I had included him as an income source in my financial info. He was a full-time college student until May \’09 and did not have a full-time job until Dec.\’09 and does not live with me any longer. I refused this documentation of course, but they have had my income docs over and over again for 2+ years.. This is just as I am learning their usual strategy to delay final loan modification. I guess they are hoping the interest rates will go back to 6.75% which is my rate and they can go after me for a payment on my jacked up mortgage balance form an original amount of $284,000 to what they now claim is $326,836 and still climbing, even though they put $11,875 in arrearages in my Chapter 13 and jumped my $1223.95 trial mod payment to a \”post petition\” amount of $1274.18. Is that even allowable after a BK has been filed.. I am not seeing that in the BK law.. Also, I have been trying to obtain a payment history for a year now and according to BK law they should have furnished one to file a claim in my BK which they did not.. My BK attorney Jim Kane (804-925-9521)is also trying to obtain one.. The only thing they have given us is a spread sheet that covers part of \’09 and \’10 and does not hsow many payments that have been made..

I orig bought home in April 2006 and with so many repairs I refinanced with Homecomings for a better rate and second in December 2006 shortly after that Note was
sold to GMAC then to Deutshe Bank and now ETS of Virginia I was refused a Mod-even afterBK and now realize that this is Fraud and a Scam!~~

my experience with countrywide now(bank of america ) has been horrible. First of all we couldnt afford the loan to begin with and the bank promised us a refinance that never happen. I was working partime and my partner made only 600$ per week before taxes and they gave us a $415,000 loan , with a mortgage payment of $3600.

hillsborough New Jersey Bank of America Complaint

I was put on a trial mod. program in jan. 2009… 1 year later I was notified of denial in the program. I was 2 pays behind then after trial mod. program..almost 3 months. Ive pd them an extra 600.00 on my mortgage from jan, feb. after rec. notice to foreclose. Now I am a little less than 90 days past. They took 1 year to deny modifaction so they could fuck me up the ass. I sent them documents on march 15, 2011 to apply for an alternate modifaction program in house. Have not heard the decision

North Las Vegas Nevada Bank of America Complaint

I had an attorney working with Countrywide to do a modification with a promise that they would not do anything without proper notification. They turned it over to B of A and shortly thereafter they surprised us and locked us out with no posted way to contact anyone. We and are senior citizens had pets in the home and medications and it took over a week to gain emergency access for only 30 minutes. One week later the home was broken into and robbed. We have good reason to believe it was by the agent and locksmith hired to do the lockout.
