My original loan was closed in 2007. I was approved for a loan modification in 2012. In late November 2012 I was sent modification papers listing not only my home and lot the original mortgage was placed on (in the original legal description), but also an adjoining piece of property I own. On 12/04/2012, I was informed by Flagstar that my mortgage had been refiled in 2010 (without my knowledge or any notice whatsoever), encumbering adjoining property that was NEVER a part of the original application, appraisal or mortgage. It appears that in 2010, the bank altered the original legal description, striking the original description from the mortgage, adding my other property and refiling the mortgage. I cannot emphasize strongly enough that at no time was my adjoining property ever a part of the original loan process in any way, shape or form. The home (which I personally built from the ground up), even with the downturn in the economy has always been more than adequate collateral and value to secure this 1st mortgage. This deceptive action by the bank was done behind my back without any notice, approval or consideration to me. I believe this was a deceptive and fraudulent act and wish to persue a claim against the bank immediately.

My husband and I applied for a home modification loan. We were told to submit certain documents such as bank statements, paycheck stubs,applications for modification, form to the Irs,and others. Some of these forms had to be submitted every month.If im not mistaken we had to start over the modification (Feb) because they said we failed to submit the monthly paper work, which was not true. We have always submitted our paper work on time, therefore,resubmit.We were told by flagstar, that we should be at least 3months behind on our mortgage to file for modification.It approx.over a year to be approved for our modification, saving us approx.30.00, which was a 3 or 6 month trial period. They would not tell me even if we made all pymts on time we may not be approved after our trial pymnts. We were urged to accept the modification even tho it would not solve our problem. During the whole time when we were going on two mos. late our mortgage would always go into default,once our mortgage had been submitted to an attorney.We also included our property taxes and home owners insurance pymts in our mortgage,we were short on one of them and our pymts went up approx. 60.00 dollars per mo.Which we are still paying.We were made to hold on the phone for approx. one hour, more or a little less.Customer service could be very cold at times.I having problems with my computer,also I could not go back and proof read. I got a letter from my bank that my insurance no longer covered the needed amount. My insurance has always been a part of the mortgage and has never changed in any way and now all of a sudden, they are forcing me to cover over 78,000 when I\’ve had 30,000 in coverage for the past 6 years. When I asked why it is changing now, they said it was an oversight. I have a mobile home on an acre of land, and 30,000 is more than enough to cover the mobile home, but they are trying to include the land in this \”total loss\” thing which is garbage.

In the process of being foreclosed on right now… Was contacted about a class action suit against Hunter Financial Group, but found out that the lawsuit had been \”squashed\” by the banks, from what my understanding is.
I live in a condo in Florida. Suddenly Flagstar claims that the HOA master wind policy does not have the correct deductible. They are threatening to put force placed insurance if I don\’t change the deductible, which I can\’t because it is the decision of the condo association and Citizens insurance will not allow changes until the renewal period. Flagstar states that I need to purchase an additional wind policy for the outer building with a lower deductible meaning I would have two policies on the same property for the full amount with two different deductibles. Citizens (the only provider of wind insurance available) will not place two policies and says that Flagstar cannot demand that. The Florida office of financial services says the same thing but Flagstar insists that they can and will.
I was in the middle of a HAMP modification program and was asked to send in updated documents. and without giving me the oportunity to rectify my situation by paying the late payments, short sale or any other method that should have had the opportunity to persue. After i faxed the documents a VA rep call me and said my property had been auctioned as of May 2, 2011. I said why and he told me the bank said i was renting my property out and i explained that my daughter and grand kids lived with me also and would contact them and let them know. he called back and said that it was too late, but it wasnt sold until the next day. I have a job but got injured and workers comp was not kicking in yet, so i had the means to pay if i would have been given the modification, which i qualified for.
I NEVER SIGNED NOT ONE SINGLE DOCUMENT, DIDN\’T KNOW ANYTHING, THE BANKS COMMITTED FRAUD, FORGERY, ALTERING, FALSFIED ASSIGNMENT OF MORTGAGE, AND PHONY ATTORNEYS THAT IS UNETHICAL THAT TOOK MY MONEY, AND I WANTIT ALL BACK. I KNOW FOR A FACT KNOW THAT A MORTGAGE THAT IS FRAUDULENT IS DEEMNED UNENFORCABLE AND NULL AND VOID. I NEED AN AGGRESSIVE LAWYER THAT WILL SUE THE PANTS OFF THESE LYING CRIMINAL HERE IN MICHIGAN!!!! I AM UPSET AND THE JUSTICE HERE IS NOT RIGHT, THERE IS NO JUSTICE HERE IN MICHIGAN, EVERYBODY IS OUT TO RIP YOU OFF AND THE ATTORNEY GENERAL CONSUMER PROTECTION IS A REAL JOKE, ALL THEY DO IS SEND OUT A LETTER. AND THAT\’S IT NO OTHER ENFORCEMENT. THAT\’S WHY THE CRIME WHITE COLLAR, AND BLUE COLLAR, AND CRIME IS SO BAD HERE, BECAUSE YOU HAVE A BUNCH OF LAZY DON\’T CARE PEOPLE THAT IS RUDE AND NASTY ON THEY PHONE WITH A I DON\’T CARE ATTITUDE AND NOT DOING ANYTHING.
it was horrible. they actually modified our loan then sold it to nationstar whom did not honor the modification and is now foreclosing.
very long wait time for responses. I feel I am being driven into foreclosure.
