This house was orginially purchased as primary residence in 2007 with 135k mortgage and 45K HELOC, both through National City. Attempted to refinance primary mortgage in 2009, was denied by PNC HELOC (National City had been sold to PNC). Would like to refi primary mortgage, but afraid will be denied again.

HAd offer on the table 4 short sale. After 3 months buyer pulled out. Kept utilities on for 7 month durring a \”deed in lieu\”. After not selling and then 3 months of review, told I didn\’t qualify for that program.
HELOC loan,original amount $191,000, increased to 209583.52 after years of payments and never receiving additional funds. ARM at closing after being sold on fixed rate.No appraisal was done in the home and no copy of appraisal was provided. Lender (National City)did not secure or file with county release of lien of second mortgage when the purpose of the loan was to pay off first and second mortgage (both first and second mortgage holders were paid off)and have new first mortgage. Broker falsified documents regarding income, appraisal value and age of home(stated home was built in 1998 when home was built in 1978. Lender force placed insurance on home increasing mortgage balance. Lender added late fees and increased mortgage amount by additional $20,000. Was shuffled from rep to rep when trying to work with bank to resolve issues. Letters went unanswered and phone calls not returned. PNC took over National City using TARP funds and has attempted to collect this debt ever since.
pnc has sent paperwork for foreclosure,I did a deed in lieu of foreclosure with david stern and his croonies in 2010,then i was sent paperwork from pnc new attorney asking if i wanted to modify,deed in lieu,etc.I have been out of the home for over a year now.pnc has sent me paperwork about the home not being insured and sent the notice to me saying they reinsured the house as if i am still there.I just want out now.i want my credit cleared,by the way credit report is still showing in the process of foreclosure.what must i do now.i have most of my paperwork can\’t afford a lawyer.
I have been working on a loan mod for over 2 years. They did sent a apology letter for screwing up my credit but I ended up having to go BK because my creditors all raise my inertest and stopped giving me credit. I own my own business. The banks are out of control.

Forensic audit shows appraisal fraud of over $400,000. Bank led us into dropping our LLC loan and at last minute declined it (with no reason ever provided) and made us sign personally or lose $100,000 deposit made to builder. Mortgage broker who arranged loan and appraisal now in jail for OTHER morgtage fraud charges…. her prosecutor WILL offer her immunity for testimony against bank and or appraiser.
