Our original lender was Bank of America. We had a perfect payment history from Sept 2009(when loan began) through June of 2013. At this time we signed up for automatic withdrawal from our bank account, and received a confirmation from Bank of America that it was approved. Within a few months, we were sent a notice from a company called Nationstar Mortgage that we were behind. We contacted Nationstar to find out what happened and they informed us that they had taken over the loan and demanded payments plus fees for well over what we owed. They did not make any adjustments based on our prior perfect history, or that they had just aqcuired the loan. We attempted to raise the money, so a few more months passed, all the while contacting Nationstar to try to work out an agreement. Never did they suggest we apply for a modification, never once would they allow us to pay the back payments and work something out for the fees. We eventually hired an attorney to help us, who then sat on the information until 3 days before the sheriff sale and told us there was nothing they could do (scam). The day before the sheriff sale I spoke with a Nationstar rep and learned I could pay approximately $11,000 up until the sale. My husband and I put the money together and called them back, and they refused to take it, saying it was too late. Our home went to auction on June 06, 2014. It did not sell, so we again tried to work something out and they refused. How is any of this legal?! It seems that Nationstar is a racket to steal homes from good lenders. Is there anything we can do?

My ex was given the home in the divorce in 2009. My name was still on loan and deed and the house has leans on it. My ex has not paid in 24 months. He was suppose to have life ins for the amount owed on the house NOT. He just to me to court to be forced to sign a quick deed he won but I am still responsible for the loan . He said he wanted to remodification so in court he said Nationstar was only waiting for the deed and he took me to court on the advice to take me to court and get me to sign deed. He has been served 3 or more foreclosures . He has tried to modify 2008-9-10&2012 which his secretary forged my name. He is over his time that he had to get modified.3 months later he is approved and I am not willing to give him another chance. His lawyer wants to work something out so he doesn\’t have to sell it by the contempt order I filed and the judge signed n be sold. . If I agree to allow him to keep the home and do the 3 good faith payments. After that he has to have a pay for a year until he can remove my name off the loan. So my attorney asked what I want to do. I want all my legal fees paid and compensation for all this distress. There is no reason for this to have gone this far. He has had so many chances . Then when I spoke to Nationstar I speak to someone different every time a different answers. They also are to email or mail me any info that they send to My ex husband. Which they have never done and I faxed emailed ètč. Even my lawyer has spoken to them.
They placed a complaint to foreclose, but there is no date – ( thank God) and there is no judge assigned at this time.
Nationstar Mortgage LLC of violating the Truth in Lending Act by not giving the modification program that they received incentives from. By them doing this they deny those who are truly in need of this modification to save there home and is getting away with it. If our president has put these laws in place why cant they honor it.
They are causing people to lose their homes, which raising homelessness, and foreclosures all over new York.

# 1. I was quoted a lower, 4.2%, rate than I recieved and was told in order to get the rate I was originally quoted, that I would have to re-fi. again next year to get a lower rate. #2. My loan was sold to Nationstar, to whom I think is affiliated with Flagstar but not sure. Before my loan was transfered to Nationstar, I was a full payment in advance, by design, and somehow lost it. It was said that I had not paid the Jan. pyment, not true. #3. When I recieved the notice of my loan being sold to Nationstar I had to call Flaggstr as to where to send my Sept.15,2011 payment, I was given an address without an account #. I sent a letter with each pymt. explaining the situation, that I had not recieved any contact from Nationsstar about the sale/transfer and asked to be RSVP\’ed ASAP. I did this for the next two months Oct.15,2011 and Nov.15, 2011! In mid- December I was sent a shody letter of the sale/transferand finally a new acct. #. #4. Prior to the sale/transfer my pymts. were due on the 15thand wer paid on time or a month in advance. Only to be told that my loan was now due on the 1st. of each monthand I could not change it!. some how, therin, I found out that I had lost my one month advance payment. In feb. or Mar. of 2012 I recieved a late pyment fee.and wrote to Nationstar to inform that I was a payment ahead before all this went down and don\’t owe a late charge. I was told that I had not paid for Jan.2012, and that is why I lost my I pymt. in-advance. When in fact it was lost due to the sudden change in my orignal due date. When I closed with Flagtar, I specificly set the due date to the 15th because my Soc.Sec. check came on the 12th of each mont and I did not want to be late. My one payment ahead was done in the early times of paying to Flagstar, and now get notices of late pymt. I have all my statements showing discrepancy. Thanks, hope you can help. signed \” DON\’T LIKED TO BE HANDLED AT 68\”!!!
