emc,lost paperwork.manytimes.took months to get inorder.keep losing paperwork.Finally got a good faith payment and I have paid it since.Now they wont take payment.Hired someone to assist..took money from me and didnt do anything.I get calls and I cant speak to them because they be little me or are very rude. I have tried over 1yr now to deal with this and i am lost. EMC has since turned over my mortgage to chase.. same issue. I dont know what to do. Ikeep paying my payment everymonth by check from automatic payment for proof of payment history. need help..sinlge parent. house in family for over 45 yrs.

pressured to purchase home. advised loan officer i had auto pmt not in my name. she stated did not have to list it. i was promised a refinance after making 6 pmts because i told her i could not afford pmts. she promised to lower pmts. after 6 months told me had to make 6 more pmts. i lost my job received foreclosure action letters. rented out house to try and save my credit. forbearance and mod denied. fraud loan due to inaccurate loan app and found out on closing day home was in a foreclosure action by current owner. the home had a yard flood problem not disclosed. everhome mortgage loan officer along with re agent met with me and pressured by both.
when i intially applied for a loan modification i was told i needed to be behind at least 3 months before i could apply for a loan mod.after i fell behind 3 months i applied for a loan mod. I specifically asked if and who i should continue to make my mortgage payments to. I was told by EMC not to make any payments during the loan modification process and that will be assesed after the loan modification process is completed, mind you i have applied for a modification 3 times and was approved the first time with a 3 month trial period, I made the payments and then I was denied the modification, but was told i could reapply again with the same stipulations do not make any mortgage payments until after the the modification process then after 8 months of submitting and re-submitting documents I was denied the loan mod under the obama plan but i was told i could apply for an IN-HOUSE loan modification through the bank at this point I asked can I go back to my original mortgage and continue with my payments. I was told the only way to do this is to pay all monies i was in arears behind in my mortgage, at this point we are talking quite a bit, but i could short sell or do the IN- House modification so we wanted to keep our home we did the in house modification process for another 8 months and was offered a trial period payment plan of more than double my original mortgage paymen. This is when i proceeded to get help from an attorney. I am trying to find out about a Quiet Title but my attorney is saying he doesnt recommend this because in the end if the lender produces the documents this could mean alot of out of pocket expenses plus potentially losing the home. My question is if they had the documents wouldnt they have filed for foreclosure or produced those documents already? I have had a an audit done and they do not have the documents. Is there any way I am elegable for this quiet title or am barking up the wrong tree?
in August 2010 emc mortgage set us on a forbearence plan when we asked for a loan modification plan that was a plan for falure.We were behind one month and need to make the next months payment. EMC took those two payments and the next three payments and set us up on an agreement prepared by the loss mitigation dept that when the first payment was due they calculated us as being six months behind and began reporting us as being so in 12/10 to the credit bureaus. For the last seventeen months we have reported as six months delinquent to the credit bureaus. we have made every payment since 12/10 on time. the only payments we missed are the ones that were in the forbearance agreement that the lender told us not to make.we were denied a modification in 10/11 and only then did we get a notice of foreclosure and realize that EMC had been reoprting us as being six monts behind on a plan that they proposed and we accepetd in good faith grateful for the help in a difficult time. indeed we were set up on a plan for falure/ is there an attorney out there?
After many letter to refinance i decided to see what they had to offer. I was told because of my good credit i could get 1percent interest for the first 2 year and then it would go up 1persent per year until it reached its max of 5.5 percent for the remainder of the loan. They also told me it would only cost $6000 and charged me like $13000. Also they didn\’t tell me that my loan was going to go up because they were charging me interest. So although i was paying 1percent that i knew about there was 4percent going back on the loan. I would have never took out a new loan had i been told the truth.
They had me dbl paying mortgage., charged excessive penalty & fees and over stated payoff which hindered me from refi my home. Applied for modification 10 times (8 times under HAMP), they would tell to submit docs for HAMP then lose docs., later I found out they never considered or submitted paperwork for HAMP. Finally submitted letter to Pres Obama & other government officials – finally received appl. for HAMP. Aft. completed paperwork & submitting while I was in last stages of review, acct was transferred to another servicer. SO MUCH ORE TO MY CASE (I HAVE BACK UP DOCS WITH RECORDED CONVERSATIONS) I have all info U R requesting I will have to upload them later.
We are in our 4th loan modification with nothing but delays and evassive answers to our questions. We continue to pay our \”trial payments\” but they are not being applied to our account and we have no idea where the monies are being held. They wil not tell us anything obout our what is going to happen after the trial payments are made.
I have been battling with EMC mortgage for years, throwing money at them only to make them richer and only for us to not benefit from it in anyway. They are constantly putting us on these bogus repayment plans, to be honest I feel as though we were on track and they are telling us no. They can\’t explain how they are using the money or where its going. They are no help at all.
difficult tu talk to some and when conected they put you on hold whrn talkind to someone they are not knowlegabel enough to give proper info wiyhout a lot of doubbel talk
after our loan I found out that the copany way over stated our income -then he said no big deal you can sell your home later-then when we fell behind they denied our mods and we had to go bankrupt chapter 11 they still would not work with us -so we went chapter 7-we are still in the home and they still refuse to modify-because they said they would lose to much money and that the #3rd party involved will not allow the modification-we said that makes no sense they responded with yup your right-can you help us
