We are with Wells Fargo ? Americas Servicing Company. Have been ongoing in Loan Modification process for about three years and eventually filed BK then went to Siringoringo Law Firm for Loan Modification. Currently placed on a payment plan however Bank representative has not returned calls on status. Have no trust in this Lender.
We have hired an attorney to file a lawsuit because they illegally seized our property and claimed it was abandoned when we were still living there. This was nearly two years ago and they still haven\’t foreclosed on our home.
They told me they would do a modification, set me up for failure. They said you have to be behind 2-3 months, they didnt care to realize I was on a motion to stay. They let my modification sit on one loss mitigation specialist for 11 months then he was reassigned to HUD vs FHA and within a week I got my first mod denial, then they realized it was there mistake child support was not added. 2008 loan was a MER and to be converted to a MIN but Wells Fargo never submitted my mortgage.
During 2009 mortgage forbearance Wells Fargo applied 1 payment to a diff loan then foreclosed and sold my home all in mistake, rescinded loan but took 9 months, to come back with over 30k added to loan. Filed 10-11666 bankruptcy to protect home then lost my job n medical issues thats when I was told to fall behind to get modif but after 18 months of them asking for documents n loosing docs a manager an loss mitigation at Wells Fargo decided that there was not enough change from previous mod application they decided to not send it to underwriting sold the next week. Asked for securitization audit Nov 5, never got my 30 day requested doc, per law 60 day to get to me but stops foreclosure process they still sold. I filed bankruptcy paperwork 13 min before sale still sold.
I went through 1 1/2 years of loan modification hell. My case is under review w/the Independent Foreclosure Review and the AG review, but I want punitive for what they put me through…They never made a decision on my modification after sending required docs over and over and over again!!!!
This is our homestead of 12 years. Freddie Mac bought the mortgage from Wells Fargo in 2003 w/o recording in the transfer with the county court. The servicer Wells Fargo did not post our payments and forced the foreclosure because we had positive equity and they wanted the positive equity.
some time between january 1 2008 and december 31 2001 my mortagage was bought from amercian serviceing corp bye Wells Fargo. but I was never told ofthis sale. I never filled a mortagage agreement with Wells fargothey then started a forcloser on my home. tried to refinance but they said no. then I tried to get them to let me sell the home on a short sell . but again they said they either lost or they never recieved the paper work is there any thing you can do to help me with this Wells fargo problem thank you Perry chmielewski
My Wife and I Moved to Texas in 1984,We purcashed our home 1986 and was told because because of our credit rateing we did not Qualify for lower interest,That once we pay a while They would reduce the interest rate, that never happen, we has ask continuously for interest reduction we only ask for fairness base on what was told us, we now know was a lie. To recieve refiancing we need good credit. which Wells Fargo made sure this could not happen if they saw poor credit in the beginning what they see now is what they help created with this burdensome excessive Rate of 9.5%. WE have conformed to all fees all charges including 9.5% interest. WE have wrote a letter to the Deputy Secretary Department of Housing and Urban Developement,The Honorable Madam Estelle Richman. Her response was for us to comunicate with the Lender,that is not what we want to do, We want JUSTICE. It\’s plain to see we are victims, being African American and over 65 year old and have paid Wells Fargo for over 25 Years paying 9.5%+ taxes, Insurance, Monthly payments of $1.200.00 totaling over $330.000.00, for a home costing only $78.000. We will we ever own it? Plese help if you can Wells fargo is very powerful. We need brave, knowledgable,righteous Lawyers.
