Attempted foreclosure after chapter 7 (2010) resulting in robosigned loan mod which destroyed our equity and now we have MERS as assignee for Mortgage America on security deed and are planning to relocate but are upside down due to mod and cant deed to note holder because that isn\’t clear. Want to avoid foreclosure as that will show on public records and prevent us from buying again. If we knew in 2010 that MERS was not a \”real\” owner we would have surrendered the home or fought the foreclosure based on that fact since the corp was dissolved in 2006 in this state.
