We had a foreclosure defense attorney who filed a defense in 2008 but the bank never responded. We had a forensic audit and the attorney demanded documents from the lender but they never produced anything since 2008. We had a private mortgage on the property that filed a foreclosure and eventually got a sale date. We filed for a chapter 13 to stop the sale and applied for the 3rd time for a modification through hamp. The private mortgage is wiped out and the hamp rejected again we have an income. The bank filed the foreclosure after the assignment of the mortgage and I do not see a recent deed recorded when we refinanced I see an old quit claim deed. I do not know if there is a mers # or not because the deed was never updated when we removed my son from it. The lender kept pursuing us into a refinance and than when we questioned the, they sent a closer to our house without an appt late at night and said we had to sign or we would never have this great opportunity again. The lender used fraudulant tactics to refinance us and also defrauded the government by lending money to owners who were not qualified to receive the mortgages based on the salary provided The mortgage was as much as my husbands salary per month and I was not on the mortgage nothing made sense
